Petition to legalize mixed beverages deemed invalid

COMMERCE — Ken Moyer’s petition to legalize the selling of all alcoholic beverages, including mixed beverages, inside Lone Star Eatery, the restaurant he owns, was not approved by the Commerce City Council on Tuesday.

The petition lacked the 398 signatures needed for the measure to be put on the May 2013 ballot.

After reviewing the 641 signatures on the petition handed to her, Commerce City Secretary Marty Cunningham said there were not enough valid signatures submitted to her office by the 60 day deadline of Jan. 14, 2013.

“There were only 381 valid signatures,” she said. “So I will not be approving this.”

The council voted unanimously in agreement with her ruling.

Currently, in order to served mixed beverages, Commerce establishments must receive a conditional use permit from the city council and then a private club permit from the Texas Alcohol and Beverage Commission. The private club permit requires patrons to be a member of the club before purchasing alcohol.

Several Commerce businesses currently have private club permits, including Lone Star and The Spot.
